Design for Good - Terms and Conditions

By accepting quotes from Design for Good (DFG) you agree to the following terms and conditions:  

1. PAYMENT

All monies dues to DFG are payable within 30 days of invoice but in the event of late payment, monies due shall carry interest at 10%.


2. DEFAULT IN PAYMENT

The Client is responsible for any costs and expenses incurred by DFG in collection of unpaid fees and of legal fees necessitated by default in payment.


3. TIME & DEADLINES


We shall perform the services you need from us and we will carry them out in a professional xand timely manner. We will endeavour to meet all the deadlines set but we cannot be responsible for a missed launch date or a deadline if you have been late in supplying materials or have not approved or signed off our work on-time at any stage. We will also treat any information that you give us with total confidentiality.


4. CLIENT RELATIONSHIP

DFG is acting as an Independent Contractor. DFG is not undertaking any artwork as an employee of the Client, nor entering into a joint venture of partnership with the Client.


5. CHANGES


We will create designs for your chosen product. This contract includes up to three design options plus the opportunity for you to make up to two rounds of revisions.


6. DIGITAL STOCK, COPY & PHOTOGRAPHY


a. Costs of any digital stock, fonts, copywriting and/or photography is not included. The Client is responsible for supplying all content & imagery prior to the project commencing.

b. Should the Client request DFG to source digital stock, fonts and/or photography on their behalf, a sourcing fee of £30 per hour will be charged along with the full cost of the item(s).DFG will hold the licence for any digital stock, fonts or photograph purchased on behalf of the client.

c. Due to licensing restrictions, DFG is unable to provide font files for any fonts used within your final artwork. Should the client wish to use the fonts, the client is responsible for obtaining a licence for usage of the font and any fees involved in the purchase and/or licensing of the font.

d. DFG does not provide support for installing and use of fonts, digital stock and photography.


7. CANCELLATION


The Client has the right to cancel its order at any point during the design process. If you are not satisfied with the designs at any stage, you will pay DFG in full for all of the work that we have produced until that point at the rate of £30 per hour for time spent. Ownership of all copyrights and the original artwork shall be retained by DFG.

If the project is put on hold by request of the Client, EDPD reserves the right to part-invoice for any work carried out to date. The Client will pay DFG in full for all of the work that they have produced until that point at the rate of £30 per hour for time spent.


8. COPYRIGHT


The copyright of all artwork created by DFG shall remain the property of DFG in accordance with the Copyright, Design and Patents Act 1996. The Client shall have no right to alter, amend or adjust the artwork created by DFG by any means whatsoever without prior permission. The Client hereby acknowledges that infringement of DFG’s copyright is  xunlawful. Artwork may be used in DFG’s advertising material, magazines, website, blog or social media pages and consent is hereby given by the Client. If the Client wishes the ownership of the rights to a specific design or concept, these may be purchased at any time for an additional cost. The Client is fully responsible for ensuring they have obtained full copyright or permissions to use any content in the artwork not provided by DFG. This includes all photography, copy and content, design elements and branding of other companies. DFG can not be held responsible for any legal action taken against the Client for unlawful use of any content within its design.


9. PROOFING


All proofreading is the Client’s responsibility. The client should thoroughly proofread all information it intends to include in its artwork prior to sending to DFG to incorporate in its design. A further proofread should be done once you have received the design. Any mistakes noticed after sign-off are not DFG’s responsibility. Any amendments will be charged at the hourly rate of £30 per hour.


10. PRINTING


Colours of printed versions of your artwork may vary to that displayed on your screen. DFG cannot be held responsible for any variations in colour. Any mistakes found after artwork has been printed are the client’s responsibility and all reprinting charges will be the responsibility of the client. For any artwork where the client arranges printing, DFG cannot be held responsible for any errors, colour matching, finishing or quality of the final printed product. DFG is not able to offer advice on printer issues. Please refer to the manufacturer’s handbook or the manufacturer’s online help services.


11. CONFIDENTIALITY


DFG shall not disclose any confidential information concerning the design to any third party without prior permission.


12. COMPLAINTS


Any complaints should be raised by the client with DFG, in writing, within 28 days of first becoming aware of the matter to be complained of and in any event within 28 days of receipt of the artwork.
